E-Verify Next Actions

Summary

This article provides a summary of the various possible E-Verify statuses. The next steps in E-Verify will depend on the result of the verification process. Each possible outcome will be shown below with a summary of the steps that need to be taken. 

Final Case Results

  • Employment Authorized
    • This result indicates that the employee's information matched the records provided to the Department of Homeland Security (DHS) or the Social Security Administration (SSA). No further action is required, and the employee's case will be closed.

    • If you believe a case received an Employment Authorization result in error, please see our Unexpected Employment Authorized Results article for more guidance.
  • Close Case and Resubmit
    • This result indicates that DHS or SSA is requiring that you close the current case, and create a new one for the employee.

  • Final Nonconfirmation
    • This result indicates that E-Verify cannot confirm the employee's employment eligibility. This result can be given after the time for resolving the case has expired, after the employee contacted DHS or SSA, or DHS closed the case without confirming the employee's employment eligibility for some other reason.

Other (Nonfinal) Case Results

  • E-Verify Needs More Time, Case in Continuance, or Verification in Process
    • These statuses indicate that the case has been referred to DHS or SSA for further verification. No action is required by the employer or employee at this time. Results may take up to 3 business days to process.

  • Photo Match
    • This status indicates that photo matching is required. The employer must confirm that the photo of the employee displayed on E-Verify matches the photo matches the photo on the document the employee provided for section 2 of their I-9 form. If the photo matches, the employer can select "Yes", this photo matches" and click "Continue to case results". Their employment should be authorized and the case should be closed. If the photo does not match, the employer should select "No", this photo does not match". After doing this, they will be prompted to upload photos directly from the employee's document. The case will either receive an Employment Authorized result or a Tentative Nonconfirmation.

  • Are You Sure?
    • This status indicates that the employee's I-9 information does not immediately match the DHS or SSA records. If the "Are you sure?" screen appears, the user will need to check the employee's information and decide whether or not it is correct. If it is, the user will select "this information is correct". If it is not, the user will select "this information is not correct" and make any corrections needed. If the information does need to be corrected, you will also need to update it on sections 1 and 2 of the I-9 form.

  • Tentative NonConfirmation
    • This status indicates that the employee's information did not match the records available to DHS or SSA. The employer should notify the employee about this status. The employee will then need to decide if they want to take their information to DHS or SSA within 10 business days to resolve the error. if the employee does decide to take action, they will have 8 business days to contact DHS or SSA. The employer may not terminate the employee as their case is under review. If they do not choose to take action, they will receive a final result indicating that E-Verify was not able to confirm employment eligibility.
