OFLC Announcement:

As stated in OFLC’s announcement on May 11, 2023, The Office of Foreign Labor Certification (OFLC) will be accepting the revised Form ETA-9089, Applications for Permanent Employment Certification in the Foreign Labor Application Gateway (FLAG) system from June 1, 2023.

As a result of the transition to the revised version of the form and the transition to FLAG, OFLC will no longer accept the previous version of Form ETA-9089 or any new applications submitted via the legacy PERM Online System after May 31, 2023, either electronically or submitted by mail.

Revised Form ETA-9089 and PERM efiling to the FLAG system from INSZoom:

Following the OFLC announcement and the release of the unofficial watermarked preview copy of Form ETA-9089, the INSZoom team at Mitratech has been working tirelessly to support this transition to the revised version of the form and the transition to FLAG.

Further, INSZoom released an update on Friday, Jun 02, 2023, to support this transition. Please take note of the below to understand what is included in the update and the scope of support for PERM online filing to the FLAG system.

a. Updates to Zoom-defined questionnaire for Form ETA-9089:

INSZoom will update the Zoom Questionnaire for Form ETA-9089 (dated 10/31/2025) to be in line with the revised Form ETA-9089.

b. Revision of Form ETA-9089:

INSZoom will revise Form ETA-9089 (dated 10/31/2025). The data population of the following fields/sections for the FLAG PERM form is not in the scope of the early June 2023 release.

• Section E Job Opportunity and Wage Information
  • PWD case number and wage fields are imported directly from the mandatory linked Form ETA-9141.
• APX B Additional Worksite Information
  • Additional worksites are imported directly from the mandatory linked Form ETA-9141.
• APX C Supplemental Information

c. PERM efiling to the FLAG system from INSZoom:

To facilitate the transition to the FLAG system, INSZoom will support the electronic filing of the revised Form ETA-9089 using INSZoom’s Desktop Add-on and the data will be pushed into the Foreign Labor Application Gateway (FLAG) portal.

Users can continue to electronically file the revised ETA-9089 form by clicking on the “E-FILE” button next to the form listed in the Case Forms list. Click here to learn more about the e-filing Desktop Add-on.

The data population of the following sections for the FLAG PERM form is limited to what is currently defined within the ETA-9089 PDF form (dated 10/31/2025):

• Appendix A.B - Foreign Worker Education: supports only 5 record sets for the population to FLAG.
• Appendix A.C - Foreign Worker Training Qualifications: supports only 3 record sets to FLAG.
• Appendix A.D - Foreign Worker Skills: supports only 2 record sets to FLAG.
• Appendix A.E - Foreign Worker Work Experience: supports only 1 record set to FLAG.

NOTE: On Jun 02, 2023, DOL published the official/ non-watermarked version of the revised Form ETA-9089. On Jun 05, 2023, INSZoom released an update with the official/ non-watermarked version of the form. INSZoom users can now prepare and submit PERM applications online to the FLAG portal as well as print Form ETA-9089 for submission by mail.
